Remote work for Indian developers: contracts, taxes and time zones
What actually changes when you work remotely for a foreign employer from India: engagement models, payment routes, compliance basics, and the working practices that decide whether it lasts.
By Ovyro Editorial
Remote roles with foreign employers are now a normal part of the Indian market rather than an exception, and the compensation difference is large enough that many developers pursue them without understanding what they are signing.
The engineering part is the easy part. The difficulty is structural: what your relationship legally is, how money reaches you, what you owe, and how you stay effective across an eleven-hour offset. This guide covers the shape of those problems. It is general information for orientation, not legal or tax advice, and anything with financial consequence should be confirmed with a qualified professional in India.
Know which engagement model you are in
Three arrangements dominate. In the first you are an independent contractor invoicing a foreign company directly. You have the most flexibility and the least protection: no notice period worth the name, no benefits, and termination usually on short notice.
In the second the company engages you through an employer of record, a local entity that formally employs you in India on the client's behalf. You get a proper Indian employment contract, statutory contributions and payroll, at the cost of some flexibility. For most people this is the better arrangement.
In the third you are employed by the company's own Indian subsidiary, which is ordinary Indian employment with a globally distributed team. Confirm which of the three applies before you discuss numbers, because the same headline figure means very different net outcomes across them.
- Contractor: highest flexibility, lowest protection.
- Employer of record: local contract, statutory benefits.
- Local subsidiary: standard Indian employment.
Read the contract clauses that actually bind you
Intellectual property assignment is the clause to read most carefully. Many templates assign everything you create during the engagement, including work unrelated to the company and done on your own time. Ask for the scope to be limited to work performed for the company, and disclose existing projects in an annexe.
Check the non-compete and non-solicit language and, more importantly, the governing law and jurisdiction. A dispute governed by a foreign jurisdiction is effectively unenforceable in either direction for an individual, which cuts against you when payment stops.
Then look for the boring protections: notice period, payment terms in days, a defined currency, who bears transfer fees, and whether equipment is provided or reimbursed. Ambiguity here is where working relationships sour.
Getting paid, and what it costs
Inward remittance to an Indian bank account is regulated, and your bank will require a purpose code and documentation for foreign receipts. Keep invoices and contracts filed, because the paperwork is requested at the point of receipt.
Compare the total cost of a payment route rather than the advertised fee. The spread on the exchange rate is usually larger than the transfer fee, and providers differ substantially. On recurring monthly payments this difference compounds into a meaningful amount over a year.
Independent contractors in India have their own registration, filing and advance tax obligations, and export of services has specific treatment. This is precisely the area where a chartered accountant costs a small fraction of what a mistake costs, and where generic internet advice is most dangerous.
- Keep contracts and invoices for every remittance.
- Compare exchange spread, not just the headline fee.
- Engage a professional before your first filing cycle.
Working across an eleven-hour offset
The teams that make this work are asynchronous by design. Written updates, decisions recorded in documents rather than calls, and a culture where a question does not block until someone wakes up. If a prospective employer's process assumes real-time availability, the offset will be a daily tax on you specifically.
Protect a fixed overlap window, typically two to three hours, and defend it in both directions. Drifting into permanent late-night availability is the most common route to burning out of a remote role within a year, and it is rarely requested explicitly; it accumulates.
Over-communicate progress in writing. When nobody sees you work, visible written output is your entire professional presence. A short daily summary of what moved, what is blocked and what is next resolves most of the trust problems distributed teams have.
The isolation problem is real
Remote work removes the informal learning that carries early-career developers, the overheard conversation, the quick desk-side review, the sense of how decisions are actually made. Compensate deliberately: ask for a mentor, request code review on work that does not strictly need it, and join the internal channels where design discussion happens.
Build a local professional life to replace the one the office provided. Meetups, an open-source community, or a group of peers you speak to weekly. This matters more for career progression than it sounds, because opportunities still travel through people.
Separate the space and the hours. A defined start and stop, and a desk that is not your bed, are not productivity aesthetics; they are what keeps the job from occupying everything.
Evaluating a remote offer properly
Adjust the headline number for what it excludes. A contractor figure with no provident fund, no gratuity, no insurance, no paid leave and self-borne equipment is not comparable to a local salary of the same size. Model the net after tax, benefits and currency conversion before comparing.
Ask how many people in India the company already employs and for how long. A company with an established Indian cohort has solved payment, compliance and time-zone questions. Being the first is a project you are taking on unpaid.
Finally, ask what happens if the role is eliminated. The answer, and how readily it is given, tells you most of what you need to know about the employer.
Frequently asked questions
Is an employer of record better than contracting directly?
For most people, yes. You get an Indian employment contract, statutory benefits and clean payroll, which removes both compliance burden and a large share of the payment risk.
Do I pay tax in India on foreign remote income?
Indian residents are generally taxed on global income, and the treatment differs between employment and independent services. Confirm your specific position with a chartered accountant before your first filing cycle.
How much time-zone overlap is workable?
Two to three fixed hours is workable when the team documents decisions. Below that, or with a team that runs on synchronous meetings, the arrangement usually degrades within months.
Should freshers take fully remote roles?
They can, but the loss of informal mentorship is significant early on. If you do, negotiate explicit mentorship and regular code review as part of the role rather than hoping it appears.
